The Conditions of Sale are an integral part of the sales contract concluded using this website. The purchaser must therefore read and accept these Conditions of Sale.

CONTRACT OF SALE
The sale of goods and services through the website www.sideaita.it is between SIDEA SRL, registered office in Gambettola (FC), via A. De Gasperi 90, share capital € 150,000.00 i.v., tax code, VAT number and registration with the Register of Companies of Forlì-Cesena no. 02693190403, (SELLER) and the customer (BUYER). By placing the purchase order, the Purchaser warrants that he/she has the necessary legal capacity to conclude purchase contracts. By placing the purchase order, the Purchaser acknowledges that he/she has read, understood and accepted all of these Conditions of Sale and has chosen a specific method of payment. Acceptance of the purchase order by the Seller will take place by sending an order confirmation message to the e-mail address that the Purchaser will have indicated during the purchase procedure on the site www.sideaita.it. The prices indicated on the site are inclusive of VAT at 22%. To benefit from different VAT rates and for any kind of information, including refund requests, please write to [email protected].

BUYER'S RESPONSIBILITY FOR DATA PROVIDED
The Buyer is obliged to provide accurate information and tax data when registering and placing the order, ensuring that he has the necessary legal capacity to conclude purchase contracts. Invoicing and dispatch of goods shall be carried out on the basis of the data provided by the Buyer.

An accurate check of the order confirmation and the immediate sending of any correction requests to [email protected]Before the invoice is issued, administrative costs can be avoided.

Otherwise, if errors are found in the tax data after the invoice has been issued, the Purchaser shall nevertheless promptly inform SIDEA SRL at [email protected]In such circumstances, SIDEA SRL reserves the right to charge the Buyer for the administrative costs incurred for the rectification operations, subject to notification and acceptance by the Buyer.

CANCELLATION OF ORDER
In the event of cancellation of the order by the Buyer for reasons not attributable to Sidea Srl (personal reasons, error in product selection, failure to enter any discount codes, etc.), the refund will be made using the same method of payment used for the purchase, with the sole deduction of bank commissions.

The Buyer may independently cancel the order only if he has chosen "Bank Transfer" as the payment method and has not made the transfer at the same time, by choosing the "CANCEL" option directly from his Profile Account in the "Orders" section.

In all other cases where the order is still in "ORDER ACCEPTED" status, to cancel an order, the Buyer must send an immediate cancellation request by email to [email protected], indicating as subject; ORDER NUMBER + CANCELLATION.

Otherwise, i.e. if the order is 'IN PROCESSING' or 'SHIPPED', it will no longer be possible to request its cancellation. It will eventually be possible to request a return on the basis of the principle 100% SATISFACTION POLICYor by exercising the RIGHT OF WITHDRAWAL as described below.

Sidea Srl reserves the right to cancel an order in the event of sudden lack of product availability or for reasons of force majeure.

TRANSPORT

Transport costs are specified during the purchase process. They are automatically calculated by www.sideaita.it according to the destination and weight/volume of the goods.  

The order processing and delivery times shown on the home page of www.sideaita.it are indicative, they are estimates based on the volume of work accumulated and the trend in transport by courier. These times can therefore not be considered essential, binding or peremptory.

Transport organised by Sidea Srl is to be considered as mere transport of the goods to the destination address. The transport does not include the transfer of the goods within the premises of the consignee and any installation of the products. The consignee is responsible for arranging the collection of the goods from the delivery vehicle by checking the integrity of the packaging and the correspondence of the number of packages with what is indicated on the transport documents. Any storage and/or redelivery costs shall be charged to the consignee in the event of negligence or error attributable to him.

Tracking is provided directly by the courier via e-mail or sms. The return is FCA warehouse Sidea. Civilly, the carrier is entrusted by Sidea on behalf of the Buyer. The risk is transferred to the Buyer when the goods are entrusted to the carrier. Transport costs are charged on the invoice. Sidea Srl is not responsible for any delays in delivery by the carrier. However, for any problem related to transport, the Buyer must immediately send an email to [email protected]The customer service team will take up the complaint and work towards a speedy solution.  

RECEIPT OF GOODS AND TRANSPORT-RELATED COMPLAINTS
Upon receipt of the goods, the consignee shall be responsible for checking the integrity of the packages and the correspondence of the number of packages with that indicated on the transport documents. In the event that the packages are damaged or fewer in number, the consignee must formulate reservations in writing on the transport document to the carrier, adding the wording "WITH RESERVE, DAMAGED PACKAGE" or "WITH RESERVE, MISSING PACKAGE" to the receipt signature. Immediately and no later than 3 days from the delivery of the goods, under penalty of forfeiture, the Purchaser is required to report to Sidea Srl any discrepancies in the goods received with respect to the contractual agreements, by writing to

RETURN OF GOODS
FCA our Gambettola plant – Incoterms® 2020 — Transport arranged by the seller on behalf of and for the account of the buyer, with the cost charged to the buyer’s invoice. Risks and liability pass to the buyer upon delivery of the goods to the carrier.

GUARANTEE
Sidea is committed to providing high quality equipment. The warranty policy reflects this commitment and is also aimed at ensuring maximum satisfaction through efficient after-sales technical service:

The guarantee for professional use of products covers manufacturing defects for one year from the date of delivery. Six months for fabric products, products with seams and elastic bands. If the Buyer is a consumer (i.e. a natural person purchasing the goods for purposes not related to professional activity) the guarantee covers against manufacturing defects for two years from the date of delivery.

Products under warranty are generally replaced, but Sidea Srl reserves the right to assess, from time to time, the opportunity to repair or replace the product, or to send spare parts. It is important to note, especially for machinery, that the guarantee is limited to the supply of the necessary spare parts. Sidea Srl is in fact obliged to bear both the costs of the spare parts and the costs of shipping the same to the address communicated by the Buyer at the time of purchase. Sidea Srl does not provide any repair service included in the warranty. The following are therefore excluded from the guarantee: assembly, labour, all related expenses, including those related to disposal or packaging, or those related to any travel by the technician at the request of the customer, whether professional or consumer purchaser.

Warranty Conditions and Exclusions

- The guarantee only covers equipment from manufacturing defects and does not include any service at the customer's premises.

- The guarantee does not cover damage caused by misuse, alteration, improper maintenance, or accidental damage.

- The guarantee is only valid for the original Purchaser and is not transferable.

- The guarantee does not cover related costs such as downtime and/or other costs.

- Any technical intervention, transport or additional expenses shall be borne by the Buyer.

 

Specific Warranty Exclusions
For all equipment, but with particular reference to 'cardio' equipment, the warranty does not cover normal wear and tear of components such as pedals, wheels, rubber handles, plastic end caps and more generally all rubber or textile parts. It does not cover wear on keyboards. It does not cover paint wear, dulling, or corrosion from perspiration.

The guarantee is not to be confused with insurance. It does not cover accidental damage due to product use, such as ball punctures. The guarantee covers manufacturing defects that impair the functionality of the equipment, rendering it unusable. However, minor defects such as small noises, vibrations or squeaks that may occur during normal use of the equipment are not included in the guarantee. Any modifications or incorrect assembly that cause damage are not covered by the warranty.

For warranty claims you will need to provide proof of purchase, indicating the invoice number, and a detailed description of the problem encountered.

100% SATISFACTION POLICY
Within 14 working days after delivery each customer, including NON-CONSUMER customers, who purchase the products for professional reasons, may return the tools purchased without penalty by obtaining a purchase credit, usable within 12 months, equal to the amount paid, excluding all shipping costs and any services. Simply send Sidea Srl communication by e-mail [email protected] indicating the equipment to be exchanged in order to receive a quotation and instructions for organising transport.

The return must be received by Sidea Srl within 14 days of authorisation. Shipping costs and the organisation of transport relating to the return of the goods shall be borne by the Customer. The goods must be returned intact, unused, complete with all its parts and in its original packaging. Any damage or deficiencies, even in the packaging, may result in partial credit. Some products imply unavoidable difficulties or impossibility to reassemble the original packaging; this does not prejudice the return, but determines a deduction from the amount credited since the packaging, and any disassembly, significantly affect the resaleability of the product.

 The 100% SATISFACTION clause does not apply in the case of “made-to-order and customised” products.

Consumer’s RIGHT OF WITHDRAWAL

Pursuant to Articles 52 et seq. of Legislative Decree 206/2005, the Consumer Code, the right of withdrawal is granted exclusively to the Purchaser who qualifies as a consumer, that is, a natural person who purchases the goods for purposes unrelated to any business, commercial, craft or professional activity they may carry out.

The consumer has the right to withdraw from the contract, without giving any reason, within 14 days of the day on which they, or a third party other than the carrier and designated by them, take physical possession of the goods.

For contracts concluded online, pursuant to Article 54-bis of the Consumer Code, the consumer may also exercise their right of withdrawal directly via the dedicated withdrawal function available in their customer area, under the “Orders” section. This function is accessible at all times throughout the entire period during which the right of withdrawal may be exercised; it provides for confirmation of the notice of withdrawal and the sending to the consumer of an acknowledgement of receipt on a durable medium, stating the date and time of transmission.

To exercise the right of withdrawal, the consumer must inform Sidea S.r.l. of their decision to withdraw by means of an explicit statement. To this end, they may use the standard withdrawal form provided for in the Consumer Code (available at the following link: WITHDRAWAL FORM ) or send a written notice to one of the following addresses:

A notice of withdrawal is deemed to have been given in good time if it is sent by the consumer before the expiry of the 14-day period.

In the event of a dispute regarding the timeliness of the exercise of the right of withdrawal, the consumer bears the burden of proving that the notice was sent within the time limit laid down by law.

Given that Sidea S.r.l. operates in the sports, training, fitness and athletic preparation sector, and that numerous purchases formally made by individuals may be intended for business, professional, associative or sporting activities, or in any case not exclusively for personal use, Sidea S.r.l. may ask the Purchaser to confirm that the purchase was made as a consumer and for purposes unrelated to any business, commercial, craft, professional, organised sporting, personal training, gym, professional practice, association or sports club activity.

The right of withdrawal does not apply to purchases made by individuals acting for purposes relating to any business, commercial, craft or professional activity they may carry out, even if the purchase was made using a tax reference number rather than a VAT number.

The right of withdrawal is also excluded, pursuant to Article 59 of the Consumer Code, for certain categories of goods and services (including goods made to measure or clearly personalised). Where the right of withdrawal cannot be exercised, this will be stated in the pre-contractual information relating to the individual product.

The direct costs of returning the goods are to be borne by the consumer. The consumer must return the goods to Sidea S.r.l. without undue delay and, in any event, within 14 days of the date on which they notified their withdrawal, unless otherwise specified by Sidea S.r.l.

The item must be returned in good condition, unused, complete with all its parts, accessories and manuals and, where possible, in its original packaging. The consumer is liable for any reduction in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods. Any damage, missing items, use of the product, alterations or deterioration of the packaging may result in a reduction in the refund, to the extent permitted by law.

Once Sidea S.r.l. has received the notice of withdrawal and verified that the applicable conditions have been met, it will refund the consumer all payments received, including standard delivery costs (excluding any additional costs arising from the consumer’s choice, by the consumer, of a delivery method other than the standard, least expensive option offered by Sidea S.r.l.), within 14 days of the date on which it was informed of the decision to withdraw. The refund will be made using the same payment method used by the consumer for the initial transaction, unless the consumer has expressly agreed otherwise and provided that they do not incur any costs. Sidea S.r.l. may withhold the refund until it has received the goods subject to withdrawal or until the consumer has provided evidence of having returned them, whichever occurs first. This is without prejudice to the direct costs of returning the goods, which are borne by the consumer, and any reduction in the refund due to a decrease in the value of the goods, within the limits set out above.

CONTROVERSIES
For any dispute the Court of Forlì-Cesena shall have exclusive jurisdiction under Italian law.
